Chapter A: General Terms (Applicable to All Services)

Acceptance: By browsing this website, contacting us for a booking, or making a deposit payment, you acknowledge and agree to be bound by these Terms and Conditions.

Jurisdiction: These terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand. Any legal disputes shall be subject to the exclusive jurisdiction of the Phuket Provincial Court.

Taxes & Fees: Prices may or may not include 7% VAT (Value Added Tax) as specified in each transaction. Credit card payments are subject to a 3% bank surcharge.

Force Majeure: The Company is not liable for failure to perform its obligations if such failure is as a result of Acts of God (including fire, flood, earthquake, storm, tsunami), government restrictions, or other events beyond our control.
Chapter B: Luxury Cars
(Refers to the “Luxury Cars” page)

Age & Experience: The Renter must be at least 25 years old and hold a valid driving license for at least 5 years.

License Requirements: A valid original Passport and a valid International Driving Permit (IDP) matching the vehicle class are mandatory. Digital copies or photos are not accepted.

Security Deposit: A substantial security deposit is required for luxury and sports vehicles (ranging from 50,000 to 200,000 THB, depending on the model), payable via credit card or cash.

Usage Restrictions:

No Track/Racing: Using the vehicle for racing, drifting, or on closed tracks is strictly prohibited. Vehicles are equipped with GPS and speed monitoring. Violations will result in immediate insurance voidance and penalty fees.

Valet Parking: It is recommended not to allow unauthorized valet services to drive the vehicle. Any damage caused by a third-party driver not listed in the contract is the sole responsibility of the Renter.

Insurance Deductible: The insurance excess (deductible) for luxury vehicles is significantly higher than standard cars. The Renter is liable for this amount in case of any damage.
Chapter C: Car Rent (Standard)

Fuel Policy: The vehicle is delivered with a full tank and must be returned full. Missing fuel will be charged at the current pump price plus a 300 THB Service Fee.

Geographical Restrictions: Vehicles are for use within Phuket Island only. Leaving the island (e.g., to Krabi, Khao Lak, or Samui) requires prior written approval. Unauthorized travel voids all insurance coverage and roadside assistance.

Cleaning: The vehicle must be returned in a reasonable condition. Excessive sand, salt water stains on upholstery, durian smell, or smoke odor will incur a Special Cleaning Fee (1,000 – 3,000 THB).

Accidents: In the event of an accident, the Renter must immediately notify the Company and the Police. Do not move the vehicle unless instructed by the insurance representative or if it poses a safety hazard.
Chapter D: Motorbike Rental

Class A License: Thai law requires a specific motorcycle license. Tourist health insurance and the motorbike accident insurance are NOT VALID if the driver does not possess a valid International Driving Permit (IDP) – Class A. Renting without a license is at the Renter’s own risk.

Helmets: Helmets are mandatory for both driver and passenger. The Renter is solely responsible for all police fines incurred for traffic violations (typically 500-1,000 THB).

Damages: Motorbikes are prone to scratches. Any damage (scratches, broken fairings) will be charged according to the official manufacturer’s (Honda/Yamaha) parts price list plus labor costs.

Theft & Negligence: In case of theft where the key was left in the ignition (negligence), the insurance does not cover the loss. The Renter will be liable for the full replacement cost of the motorbike.
Chapter E: Villas & Accommodation
(Refers to the “Villa” pages)

Electricity Allowance: Rental rates include a daily electricity allowance of [X] Units. Excess usage will be charged at 7-8 THB per Unit. Meter readings are taken at Check-in and Check-out.

Noise & Parties: Villas are often located in residential areas. Excessive noise or loud music after 22:00 (10 PM) is prohibited. Police intervention due to noise complaints will result in a 5,000 THB fine and immediate eviction without refund.

Security Deposit: A cash security deposit is required upon Check-in. It will be refunded at Check-out pending an inspection. Damages to furniture, stained linens (ink, wine, blood), or broken items will be deducted from the deposit.

Guest Limits: Accommodation is strictly for the number of guests stated in the booking. Unregistered overnight guests are not permitted.
Chapter F: Trips & Excursions
(Refers to the “Trips” page)

Weather & Cancellations: The Company reserves the right to modify routes or cancel trips based on Marine Department orders or unsafe sea conditions. In such cases, a rescheduled date or a full refund will be offered.

Health Declaration: Pregnant women and individuals with back problems or heart conditions are strictly prohibited from traveling on Speedboats. The Company accepts no liability for injuries resulting from the non-disclosure of these conditions.

Personal Belongings: The Company is not responsible for loss or damage to electronic devices (phones, cameras, drones) due to water, sand, or impact during the trip. Use of waterproof bags (Ocean Packs) is highly recommended.

Pick-up: Failure to be at the hotel lobby at the designated pick-up time (beyond a 10-minute grace period) will be considered a “No Show,” and no refund will be issued.
Chapter G: Fitness
(Refers to the “Fitness” page)

Health Waiver: Use of gym facilities is at the user’s own risk. The user declares they are physically fit and healthy to exercise.

Attire & Hygiene: Closed-toe sports shoes and a personal towel are mandatory. Training barefoot or in sandals is not allowed.

Equipment: Weights and equipment must be returned to their racks after use. Willful damage or damage caused by misuse will be charged to the user.

Valuables: Do not leave valuables in lockers overnight or unattended. Management is not responsible for theft or loss of personal items.
Chapter H: Kosher Restaurant

Kosher Supervision: The establishment operates under strict Kashrut supervision. Customers are welcome to view the current certificate. Any Halachic questions regarding food preparation or ingredients should be directed to the on-site supervisor (Mashgiach).

Reservations & Seating: Tables are held for a maximum of 15 minutes past the reservation time. After this period, the table may be released to walk-in guests. We cannot guarantee specific table locations, though requests will be noted.

Pricing, Service Charge & VAT: All menu prices are stated in Thai Baht (THB). Please check the menu to see if prices are subject to 7% Government VAT and/or a 10% Service Charge, which will be added to the final bill.

Food Allergies & Dietary Restrictions: It is the customer’s mandatory responsibility to inform the staff of any food allergies prior to ordering. While we take precautions, our kitchen environment may contain traces of nuts, gluten, sesame, eggs, and dairy. The Company accepts no liability for allergic reactions if the specific allergy was not disclosed.

Outside Food & Beverages: Strictly NO outside food or drinks are allowed within the restaurant premises. This is enforced to maintain our Kashrut certification and hygiene standards. Violators may be asked to leave.

Alcohol & Conduct: We reserve the right to refuse service to any guest who appears intoxicated or behaves in a disorderly or aggressive manner towards staff or other guests.
Chapter I: Car Care
(Refers to the “Car Care” page)

Valuables: The Company is not responsible for cash, jewelry, or valuables left inside the vehicle during washing or detailing. Please remove all valuable items before handing over the keys.

Pre-existing Damage: The customer acknowledges that high-pressure washing or polishing may reveal pre-existing damage (such as peeling paint or scratches previously hidden by dirt). The Company is not liable for damages resulting from normal wear and tear.

Collection: Vehicles must be collected immediately upon completion of the service. Vehicles left beyond operating hours may incur parking fees.
Chapter J: Barbershop
(Refers to the “Barbershop” page)

Appointments: Booking in advance is recommended. Customers with appointments have priority over walk-ins.

Lateness: Arriving more than 10 minutes late may result in appointment cancellation or a shortened service time to accommodate the next client.

Satisfaction: If the customer is dissatisfied with the haircut, they must inform the staff before payment so that corrections can be made (if possible). No refunds will be issued once the customer has left the premises.
Privacy Policy (PDPA Compliant)

HALELUYA PHUKET. (“The Company,” “We,” “Us”) respects your privacy. This Privacy Policy outlines how we collect, use, and protect your personal data in compliance with Thailand’s Personal Data Protection Act (PDPA) B.E. 2562 (2019).

Depending on the service you book (Car Rental, Villa, Trips, etc.), we may collect the following personal data:

Legal Compliance: To comply with Thai Immigration (TM.30 reporting) and Police regulations regarding vehicle rentals.

Communication: To send booking confirmations, updates, or emergency notifications.

Security: GPS tracking data from rental vehicles is used solely for asset protection and safety.
4. Data Sharing
We do not sell your personal data. We may share your data with:

Authorities: Thai Police or Immigration Bureau if required by law.

Service Partners: Tour operators or boat companies (only strictly necessary info like names for insurance purposes).

Insurers: In the event of an accident or claim.
5. Data Retention
We retain your personal data only for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.
6. Your Rights
Under the Thai PDPA, you have the right to request access to your personal data, request correction of inaccurate data, or request deletion of your data (subject to our legal obligations to retain records).
